The fine for a first time offender is a maximum of $200 plus a surcharge of $88 in City Court, $93 in Town or Village Courts.  5 points are assessed for this violation upon conviction. Texting or other cell phone use by drivers under the age of 18 or probationary license holders will result in suspension for 120 days for first offense, and a year suspension on a second offense.  Hand free devices are still permitted.
