the three degrees of a suspended license in NY
There are three degrees of driving with a suspended license in New York. Aggravated Unlicensed Operation of a Motor Vehicle in the third degree (VTL §511.1) is a misdemeanor crime. This occurs when a person is driving on a public road while knowing or having reason to know that his or her license or privilege of obtaining a license is suspended or revoked. The penalty for this charge is a fine of between $200 and $500, and up to 30 days in jail.
Aggravated Unlicensed Operation of a Motor Vehicle in the second degree (VTL §511.2), also a misdemeanor crime, can be committed in a variety of ways. The most common violation of this section is driving while your license is suspended or revoked for a DWI offense. Another common violation results from driving while a person has in effect three or more suspensions imposed on at least three separate dates for failure to appear in court or pay a court fine. The penalties for this misdemeanor are a fine of between $500 and $1,000, up to 180 days in jail, and/or up to 3 years’ probation.
Aggravated Unlicensed Operation of a Motor Vehicle in the first degree is a class “E” felony crime (VTL 511.3) and can be committed in a variety of ways. The first subdivision contains the felony offense and involves the aggravating factor of driving the vehicle while suspended or revoked while intoxicated or impaired by alcohol or drugs in violation of VTL 1192 (2), (3), (4), or (5). The penalties for this felony are a fine of between $500 and $5,000, up to 4 years in state prison, and/or 5 years’ probation.
